We have a zero-tolerance approach to bribery and corruption in all its forms.
Our Position
PDA Law Solicitors Limited has a zero-tolerance approach to bribery and corruption. We are committed to acting professionally, fairly, and with integrity in all our business dealings and relationships, wherever we operate.
We will uphold all laws relevant to countering bribery and corruption in all the jurisdictions in which we operate, including the Bribery Act 2010.
What This Policy Covers
This policy applies to all individuals working for us or on our behalf in any capacity, including:
- Directors and partners
- Employees (permanent, fixed-term, and temporary)
- Consultants and contractors
- Agents and third parties acting on our behalf
What is Bribery?
Bribery is offering, promising, giving, accepting, or soliciting an advantage as an inducement for action that is illegal, unethical, or a breach of trust. It can take many forms, including:
- Cash payments or gifts of significant value
- Hospitality or entertainment that goes beyond what is reasonable and proportionate
- Facilitation payments — small payments made to officials to speed up routine actions
- Kickbacks or referral fees paid or received improperly
Our Prohibitions
We strictly prohibit:
- Offering, promising, or giving a bribe to any person
- Requesting, agreeing to receive, or accepting a bribe from any person
- Bribing a foreign public official
- Making or accepting facilitation payments of any kind
- Engaging a third party who we know or suspect will offer a bribe on our behalf
Gifts and Hospitality
We recognise that the giving and receiving of gifts and hospitality is a normal part of doing business. However, it is not acceptable to give or receive gifts or hospitality that could be seen as an attempt to improperly influence a business decision.
All gifts and hospitality above a nominal value must be recorded in our gifts and hospitality register. Any gift or hospitality that appears disproportionate or inappropriate must be declined and reported to a director.
Referral Arrangements
As a law firm regulated by the Solicitors Regulation Authority, we are subject to strict rules on referral arrangements. We do not pay or receive referral fees in circumstances that would breach the SRA Standards and Regulations. Any referral arrangements we enter into are disclosed to clients in accordance with our regulatory obligations.
Reporting Concerns
We encourage all staff to raise concerns about any issue or suspicion of bribery or corruption at the earliest possible stage. We have a whistleblowing policy that protects staff who raise genuine concerns in good faith from any form of retaliation.
Concerns can be raised with any director or, where appropriate, directly with the Solicitors Regulation Authority.
Consequences of Breach
Any employee found to have breached this policy will face disciplinary action, which may include dismissal for gross misconduct. We reserve the right to terminate our relationship with other individuals and organisations working with us if they breach this policy.
Bribery is a criminal offence under the Bribery Act 2010. Individuals convicted of bribery can face up to 10 years' imprisonment and an unlimited fine.
