Why PDA Law
Know Your Rights in the Workplace
Led by Alex Bailey, our employment law team provides expert advice for employees facing workplace disputes. Many companies do not operate in-house HR departments, and it isn't always easy to find information relating to your rights as an employee.
If you are facing bullying and harassment, or have been treated unfairly in any way, we can advise you on your next steps and represent you at an employment tribunal if necessary.
Employment Tribunals
Usually relate to unfair dismissal, discrimination claims, and unfair deductions from pay. The time limit is usually three months.
Workplace Bullying & Harassment
Bullying can include malicious rumours, unfair treatment, regular verbal abuse, and being blocked for promotion.
Settlement Agreements
We review and advise on settlement agreements to ensure you receive fair compensation for your claims.
Frequently Asked Questions
What is unfair dismissal?
Unfair dismissal occurs when your employer terminates your employment without a fair reason or without following a fair procedure. You must have been employed for at least 2 years to bring a claim.
What is constructive dismissal?
Constructive dismissal is when you resign because your employer's conduct made it impossible for you to continue working there. This is treated as a dismissal in law.
How long do I have to make a tribunal claim?
Usually 3 months from the date of dismissal or the act complained of. You must also go through ACAS Early Conciliation first.
What is a settlement agreement?
A legally binding agreement between you and your employer to settle any employment claims. You must receive independent legal advice before signing.
Can I claim for discrimination at work?
Yes, if you have been treated less favourably because of a protected characteristic (age, disability, gender, race, religion, sexual orientation, etc.).
