Yes — provided you still have mental capacity at the time of making the LPA. Mental capacity is decision-specific and time-specific, so even if you have been diagnosed with a condition that may affect your capacity in the future, you may still be able to make a valid LPA now. What is the difference between a power of attorney and an LPA?
An ordinary power of attorney is only valid while you have mental capacity — it automatically becomes invalid if you lose capacity. A Lasting Power of Attorney (LPA) is specifically designed to continue (or come into effect) after you lose capacity. For long-term planning, an LPA is almost always the right choice.
Do I need both types of LPA?
Most people benefit from having both a Property & Financial Affairs LPA and a Health & Welfare LPA. Together, they provide comprehensive protection — covering both financial matters and medical/care decisions. We offer a bundle discount when you make both LPAs at the same time.
What happens if I lose capacity without an LPA?
If you lose mental capacity without an LPA in place, your family has no automatic legal authority to manage your affairs. They would need to apply to the Court of Protection for a deputyship order — a process that is significantly more expensive, time-consuming and stressful than making an LPA in advance.
