Common Calculation Mistakes

Using gross income instead of net

The calculator uses gross annual income. Courts assess net income (after tax and National Insurance). Your actual maintenance figure may differ.

Ignoring capital assets

If one party has significant capital assets (property, savings, investments), these may reduce or eliminate a maintenance claim — even where there is a large income gap.

Forgetting pension income

Pension income counts as income for maintenance purposes. If either party is close to retirement, pension projections should be included in the assessment.

Not considering earning capacity

Courts assess realistic earning capacity — not just current income. If the recipient is underemployed or has deliberately reduced their income, the court may impute a higher income.

How to Use This Calculator Effectively

1

Use gross annual income

Enter gross (pre-tax) annual income for both parties. Include all income sources — salary, self-employment income, rental income and investment income.

2

Be honest about earning capacity

Courts assess realistic earning capacity, not just current income. If either party is underemployed or has deliberately reduced their income, the court may impute a higher figure.

3

Consider the full financial picture

This calculator focuses on income. Capital assets (property, savings, investments) can significantly affect maintenance — a party with substantial capital may not need maintenance even with a lower income.

4

Use it as a starting point

This calculator provides an indicative estimate based on the most common factors. Every case is different. Speak to Martin Dias for a precise assessment based on your specific circumstances.

Funding Your Legal Fees

Own a property? You may not need savings to fund your case.

If you jointly own the matrimonial home, a Sears Tooth agreement allows us to secure our fees against your share of the property — meaning no upfront payment is required. Fees are deducted when the property is sold or transferred. This option is particularly suited to non-working spouses or those with limited income.

Explore all funding options

We do not accept legal aid cases. PDA Law is a private client practice. All family law matters are funded privately — through direct fees, payment plans, or a Sears Tooth agreement where applicable.
