The No-Fault Divorce Process

Since April 2022, couples in England and Wales can divorce without having to blame each other. The process involves:

  1. Application: One or both spouses apply to the court stating the marriage has irretrievably broken down.
  2. 20-week reflection period: A mandatory waiting period before applying for the conditional order.
  3. Conditional order: The court confirms there is no reason why you cannot divorce.
  4. Final order: Applied for 6 weeks after the conditional order — this legally ends the marriage.

The financial settlement is dealt with separately and can be agreed at any stage. We strongly recommend obtaining a consent order to make any financial agreement legally binding.
